By accessing and using the RBR Growth Consulting website and services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

2. About Us

RBR Growth Consulting LLC, operating as RBR Growth Consulting, is a LLC organised in the United States. References to "we," "us," "our," or "RBR Growth Consulting" in these Terms mean RBR Growth Consulting LLC.

We are the sole operator of the services and the text messaging program described in these Terms. We use third-party service providers, including our messaging platform, to help deliver them, but responsibility for the program rests with us.

3. Services Description

RBR Growth Consulting provides digital marketing and growth consulting services including but not limited to Google Ads management, search engine optimization (SEO), Google Business Profile optimization, call tracking, lead generation, and marketing strategy for dental practices, law firms, and home service businesses.

4. Text Messaging (SMS) Program

Program name: RBR Growth Consulting Client & Customer Notifications.

Program description: We send transactional and informational text messages relating to scheduling, service visits, account activity, and requested information. This includes appointment confirmations and reminders, notice that a representative or crew is on the way to a scheduled visit, requests for information needed to complete a service such as site photographs, follow-ups on an inquiry you have already made, and replies to questions you send us by text.

No promotional messaging. This program does not send marketing or promotional text messages. Every message relates to an existing or requested service relationship.

Who sends the messages: RBR Growth Consulting is a marketing agency and operates this program on its own behalf and on behalf of the client businesses whose communications it manages. Messages are sent from the phone number associated with the relevant business.

Consent: Consent is obtained directly from the recipient through an unchecked checkbox on our contact form, verbally during a call with the response recorded, or by the recipient texting us first. Consent is never purchased or acquired from a third party and is never a condition of purchase. Full detail is set out in our SMS Terms & Conditions.

Message frequency: Message frequency varies based on your activity and the status of your service or inquiry. You will typically receive between 1 and 10 messages per month.

Message and data rates: Message and data rates may apply. Please consult your mobile carrier plan for details. RBR Growth Consulting is not responsible for any charges incurred from your mobile carrier.

Opt-out (STOP): You can cancel this service at any time. Just text STOP to the number you received the message from. We will reply to confirm that you have been unsubscribed, and you will receive no further messages. If you want to join again, sign up as you did the first time.

Carriers not liable: Wireless carriers are not liable for delayed or undelivered messages.

Privacy: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third party. See our Privacy Policy.

5. Client Obligations

Clients agree to provide accurate and complete information necessary for the delivery of services. Clients are responsible for granting timely access to accounts, platforms, and assets required for campaign execution. Delays caused by client non-responsiveness may affect campaign timelines and results.

6. Payment Terms

Payment terms, fees, and billing schedules are outlined in individual client service agreements. All fees are due as specified in the applicable agreement. Late payments may result in suspension of services. Ad spend budgets are separate from management fees and are paid directly to advertising platforms.

7. Intellectual Property

All content on this website, including text, graphics, logos, and design elements, is the property of RBR Growth Consulting and is protected by applicable intellectual property laws. Campaign assets created for clients become the client's property upon full payment of associated fees.

8. Results & Guarantees

While we strive to deliver measurable results for every client, RBR Growth Consulting does not guarantee specific outcomes, rankings, or revenue figures. Results vary based on market conditions, competition, budget, and other factors outside our control. Case studies and testimonials represent individual client experiences and are not guarantees of future performance.

9. Limitation of Liability

RBR Growth Consulting shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. Our total liability for any claim shall not exceed the amount paid by you for the services giving rise to the claim during the twelve months preceding the claim.

10. Termination

Either party may terminate services in accordance with the terms outlined in the individual client service agreement. Upon termination, the client will receive all campaign data, assets, and reporting generated during the engagement. We reserve the right to terminate access to our website for any user who violates these terms.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Albany County, New York.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Your continued use of our website and services after changes are posted constitutes acceptance of the modified terms.
